Kerry “Qays” Arthur, the service provider, offers WordPress deployment and maintenance services, such as staging and deploying a WordPress production website, updating plugins, themes, and core files, performing backups, security scans, and performance optimization, general support, and fixing bugs and errors, via the website QaysArthur.net.
By registering for L2 WordPress Support and Monitoring Services you hire the service provider to perform WordPress maintenance and support services for your website on a monthly basis. The service provider agrees to provide such services for one website under the following terms and conditions:
- Areas of Responsibility. The service provider will be responsible for the following general tasks pertaining to the client’s website on an ongoing basis:
- ensuring the website is kept up to date,
- ensuring suitable industry-standard security measures are in place,
- ensuring suitable industry-standard performance measures are in place,
- ensuring a back-up solution is in place,
- ensuring Google Analytics is setup and maintained to accurately extract data from the website,
- ensuring basic ecommerce functionality runs smoothly (i.e. that the ecommerce solution of choice functions properly as advertised without modification or customization),
- ensuring email delivery is kept at industry standard levels,
- providing general support in the form of advice via email or other communications means in addition to troubleshooting solutions implemented on the website.
- Fees. The client will pay the service provider a monthly retainer fee of $750 in advance for the L2 WordPress Support and Monitoring Services. The retainer fee covers all tasks directly related to the Areas of Responsibility. The costs of plugins and third-party solutions will be borne by the client.
- Additional Tasks. Tasks or feature requests outside the areas of responsibility[1], or tasks substantial enough to be deemed projects[2] (even when within the areas or responsibility) will incur additional fees based on the nature and scope of the request as agreed upon in advance. The service provider will invoice the client for any such additional tasks or projects performed as well as any payments made on behalf of the client for plugins or third-party services. The client will pay the invoice within 3 days of receipt. The foregoing applies whether the task or project was requested on the client’s own initiative or based on the service provider’s advice.
- Communication. The client will communicate with the service provider via email to request tasks, provide feedback, or report issues. The service provider will respond to the client’s requests within 24 hours and complete the tasks in a timely manner as agreed upon by both parties. Support emails with “urgent” in the subject will be responded to within 60 minutes. This commitment applies to seven requests per month. More than seven such requests will be subject to additional fees.
- Evaluation. This agreement will be subject to periodic evaluation and amendment as mutually agreed upon by both parties.
- Termination. This agreement will commence on the date of registration and will continue until terminated by either party. Either party may terminate this agreement at any time by giving written notice to the other party and thereafter using the relevant link on the service provider’s website to terminate membership. Upon termination, the service provider will stop performing any tasks and the client will pay any outstanding fees for the tasks performed until the date of termination.
- Disclaimer. The service provider will use reasonable care and skill in performing the WordPress maintenance and support services but does not guarantee that the client’s website will be error-free, secure, or optimized at all times. The service provider is not liable for any damages or losses arising from the use or misuse of the client’s website or any third-party products or services installed on the website.
- Governing Law. This agreement is governed by applicable laws in accordance with the Sharia. Any disputes arising from this agreement will be resolved by Sharia arbitration before other remedies are sought.
